Terms of Service

This document is a template and must be reviewed by a qualified lawyer before launch.

Welcome to PvPScout. These Terms of Service ("Terms") govern your access to and use of pvpscout.com and any related pages, features, apps and services (together, the "Service"). By creating an account, submitting a listing, making a purchase or otherwise using the Service, you agree to these Terms and to the policies they refer to: the Privacy Policy, Cookie Policy, Community Guidelines, Advertising and Listing Policy, Refund and Subscription Terms, and Copyright and Trademark Notice policy. If you do not agree, please do not use the Service.

1. What PvPScout is

PvPScout is a global, bilingual (Turkish and English) directory of private and community PvP servers for MMORPGs and other online games. Server owners submit listings; users browse, vote, review and report content.

PvPScout does not own, operate, host or control any listed server. Each server is run by an independent third party who is solely responsible for its game, website, downloads, community, rules, payments, refunds and support. We do not verify every claim made in a listing and we do not guarantee that a server is safe, legal in your country, online, fair or honest. Any dealings you have with a server, including any payment you make to it, are strictly between you and that server.

Game names, logos and other marks displayed on the Service are trademarks of their respective owners. PvPScout is not affiliated with, sponsored by or endorsed by any game publisher or developer. Rights holders can use our notice-and-takedown process described in the Copyright and Trademark Notice policy.

2. Eligibility and age

• You must be at least 13 years old to create an account.
• If you live in a country of the European Economic Area or another jurisdiction that sets a higher age for consenting to online services (up to 16), you must meet that age or have consent from a parent or legal guardian.
• If you are under 18, you need permission from a parent or legal guardian before making any purchase.
• You must be legally able to enter into a binding agreement, or have your parent or guardian accept these Terms for you.

3. Your account

• You can register with an email address and password, or sign in with Google or Discord. When you use a third-party sign-in, that provider's terms also apply.
• You choose a username and may add an optional avatar and bio. Usernames, avatars and bios must follow the Community Guidelines; we may change or remove ones that do not (for example, impersonation, offensive names or names of real brands used misleadingly).
• You are responsible for keeping your login details secure and for all activity on your account. Tell us at destek@pvpscout.com straight away if you think your account has been compromised.
• One person, one account. Creating multiple accounts, sharing accounts or buying and selling accounts is not allowed.
• You can delete your account at any time from your account settings or by contacting us. See the Privacy Policy for what happens to your data.

4. Voting, reviews and reports

• Signed-in users can vote once per server per UTC day. Monthly vote totals reset on the 1st of each month (UTC).
• You may write reviews and optionally give a 1 to 5 star rating. Reviews must reflect your own genuine experience.
• If you are an owner, staff member, moderator or otherwise connected to a server, you must disclose this in any review of that server, and you may not vote-manipulate or post reviews intended to boost your own server or harm a competitor.
• You can report listings, reviews and users that you believe break the rules. Please do not abuse the reporting tool.

5. XP, levels, badges and referrals

The Service includes gamification features such as XP, levels, badges, daily and weekly challenges, vote streaks, monthly leaderboards and a referral program (the referrer earns XP when the invited user casts their first vote).

• XP, levels, badges, streaks, leaderboard positions and similar items ("Rewards") have no monetary value, cannot be redeemed for cash or goods, and cannot be transferred, sold or traded.
• Rewards are a limited, revocable feature of the Service, not your property.
• We may change how Rewards work, and we may reset, adjust or remove Rewards, or disqualify users from leaderboards and the referral program, where we detect abuse such as bots, multiple accounts, self-referrals or vote manipulation.

6. Server listings

If you submit a server listing, you confirm that:

• you are the owner of the server or are authorised by the owner to list it;
• the information in the listing (name, game, version, rates, opening date, links, images, description) is accurate and kept up to date;
• you have the rights to all text, images, videos and logos you upload, or are using them lawfully;
• the server and its website do not distribute malware or phishing, and do not sell cheats, hacks or bots;
• the listing complies with the Community Guidelines and the Advertising and Listing Policy.

Only one listing per server is allowed. We may review, edit for formatting, hide, reject or remove listings, and we may mark listings as verified or unverified. Verification only means we have performed certain checks at a point in time; it is not a guarantee or endorsement.

By submitting a listing, you agree that we may publish it on the Service and share public listing information (for example, name, game, short description, link and image) on our social media and our public Telegram channel to promote it.

7. Content you post

"User Content" means anything you post on the Service: reviews, ratings, listings, images, profile information and reports.

• You keep ownership of your User Content.
• You grant PvPScout a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for example, resize images or translate), display and distribute your User Content in connection with operating, improving and promoting the Service. This licence ends when you delete the content or your account, except for copies kept for legal reasons, in backups for a limited period, or content already shared with others.
• You are responsible for your User Content and confirm that it does not infringe anyone's rights or break the law.
• We do not pre-screen all content, but we may remove or restrict any content, and take action against accounts, under the Community Guidelines and applicable law. Where required by law (for example, the EU Digital Services Act), we will tell you the reasons for our decision and how to challenge it.

8. Acceptable use

You agree not to:

• manipulate votes, rankings, reviews or Rewards, including with bots, scripts, multiple accounts, VPN farms, paid voting or vote-for-reward schemes;
• scrape, crawl or copy the Service at scale without our written permission, except for standard search engine indexing;
• interfere with the security or operation of the Service, probe for vulnerabilities without permission, or bypass rate limits;
• post malware, phishing links, illegal content, or content that harasses, threatens, doxxes or promotes hatred against others;
• sell or advertise cheats, hacks, bots, account or item real-money trading, gambling or other prohibited products;
• impersonate any person, server or organisation;
• use the Service in breach of any law that applies to you.

9. Paid products

We offer optional paid products:

• Payments are processed by Stripe. Prices are shown in US dollars; taxes such as VAT may be added depending on your location. Your bank may charge currency conversion fees.
• Subscriptions renew automatically at the end of each billing period until you cancel. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
• Paid placement does not buy votes, ratings or reviews. Rankings by votes remain organic, and paid placements are labelled as featured or sponsored.
• Paid features may be removed without refund if the listing or account is suspended for breaking these Terms, to the extent permitted by law.
• Details on renewals, cancellations, withdrawal rights and refunds are set out in the Refund and Subscription Terms, which form part of these Terms.

We may change prices for future billing periods. We will tell you in advance, and you can cancel before the new price applies.

10. Advertising

The Service displays advertising, including direct-sold banners and Google AdSense. Personalised ads are only shown with your consent where consent is required. Advertisers must follow our Advertising and Listing Policy. We are not responsible for third-party ads or the sites they link to.

11. Third-party links and services

The Service links to server websites, Discord servers, download pages and other third-party sites. We do not control them and are not responsible for their content, security or practices. Downloading game clients or files from third-party servers is at your own risk.

12. Our intellectual property

The Service, including its design, software, logos, the PvPScout name and our original content, belongs to PvPScout or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify or reuse our branding or code without our written permission.

13. Suspension and termination

We may warn you, remove content, reset Rewards, hide listings, restrict features, or suspend or terminate your account if you break these Terms or the Community Guidelines, if required by law, or to protect users or the Service. Where reasonable, we will explain why and give you a chance to respond. You can stop using the Service and delete your account at any time.

14. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that the Service will be uninterrupted or error-free, or that listings, reviews, votes or other information are accurate, complete or current. We are not responsible for listed servers, their operators, or anything that happens on or through them, including lost game items, account bans, payments made to servers or malware distributed by third parties.

15. Limitation of liability

To the extent permitted by law:

• PvPScout is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill;
• our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for gross negligence, intent, or death or personal injury caused by negligence, and nothing affects your mandatory consumer rights.

16. Indemnity

If you are using the Service as a business (for example, as a server owner or advertiser), you agree to compensate PvPScout for claims, losses and reasonable costs arising from your listing, ads, User Content or breach of these Terms, to the extent permitted by law.

17. Changes to the Service and these Terms

We may update the Service and these Terms. If we make material changes, we will notify you on the site or by email before they take effect. If you keep using the Service after the changes take effect, the updated Terms apply. If you do not agree, you can stop using the Service and cancel any subscription.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction.

• Consumers in Turkey may also apply to the Consumer Arbitration Committees (Tüketici Hakem Heyeti) or consumer courts within the monetary limits set each year under Law No. 6502 on Consumer Protection, generally in the place where they live or where the transaction took place.
• Consumers in the EU, EEA, UK or elsewhere keep the protection of the mandatory provisions of the law of their country of residence and may bring proceedings in the courts of their country where the law allows. Nothing in this section removes those rights.

19. Miscellaneous

• If any part of these Terms is found invalid, the rest remains in effect.
• If we do not enforce a right immediately, we have not waived it.
• You may not transfer your rights under these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, provided your rights are not reduced.
• These Terms are available in Turkish and English. If there is a conflict, the Turkish version prevails for users in Turkey, and the English version prevails for everyone else, unless mandatory law requires otherwise.
